Trueburn Terms of Use

By using Trueburn you agree to these terms.
1. What Trueburn is
Trueburn is an iPhone app for recording what you eat and what you weigh, and for estimating your energy expenditure from that record. It is published by Utileau.
2. Not medical advice
Trueburn is not a medical device and does not provide medical advice, diagnosis or treatment.
The calorie and macronutrient targets it produces are estimates calculated from information you enter and from your own logged data. They are not a prescription and they are not supervised by a clinician.
Nutrition is individual. If you are pregnant or breastfeeding, under the care of a doctor, managing a health condition such as diabetes or kidney disease, recovering from an eating disorder, or taking medication affected by diet, speak to a qualified healthcare professional before changing how you eat, and follow their advice over anything this app says.
Trueburn applies safety limits to every target it produces — it will not set a calorie target below 1,200 kcal for women or 1,500 kcal for men, will not set a rate of loss faster than roughly 1% of bodyweight per week, and will not accept a goal weight below a BMI of 18.5. These limits apply to every user regardless of age. They are a floor, not a recommendation, and they are not a substitute for professional advice.

3. Accuracy of the food data
Generic food data comes from the USDA FoodData Central database, a work of the United States government in the public domain. Barcode data comes from Open Food Facts, an open database contributed to by the public and licensed under the Open Database Licence.
Neither we nor those sources guarantee that any nutrition figure is accurate, complete or current. Product formulations change, labels contain errors, and contributed data is entered by hand. Treat every number as an estimate. Where it matters, check the packaging.
4. Your data is yours
We do not collect, store or have any access to your data. See the Privacy Policy.
Because your data lives on your device and in your own iCloud account, you are responsible for keeping it. Deleting the app, signing out of iCloud, losing the device or using “Delete all data” will remove it, and we cannot recover it for you — we never had a copy. Trueburn provides an export function; use it if the record matters to you.
5. Purchases
Trueburn is free to use. Every feature is available to everyone at no cost.
The app offers a single optional in-app purchase, a one-time voluntary contribution. It unlocks no features, because no features are locked. It is not a subscription and it does not renew.
Purchases are processed by Apple, tied to your Apple Account, and governed by Apple's terms. We cannot issue refunds, because we never receive your payment or your identity. Refund requests go to Apple, through reportaproblem.apple.com.
6. Acceptable use
Do not attempt to reverse-engineer, redistribute or resell the app, and do not use it to break the law. Do not use the app to make automated requests to Open Food Facts beyond normal personal use.
7. Third-party licences
- USDA FoodData Central — public domain (a work of the US Government).
- Open Food Facts — the database is licensed under the Open Database Licence (ODbL); individual contents under the Database Contents Licence. Trueburn attributes Open Food Facts in the app and links to the source.
8. No warranty
Trueburn is provided “as is”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Utileau is not liable for any indirect, incidental, special or consequential loss, or for any loss of data, arising from your use of Trueburn. Where liability cannot be excluded, it is limited to the amount you have paid us for the app — which, for almost everyone, is nothing.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, these terms do not affect your statutory rights.
10. Changes
We may update these terms. Material changes will be reflected in the “last updated” date above and, where the change affects how the app behaves, in the release notes.
